Staying Power Website Terms and Conditions
Effective date: October 9, 2026
1. About these Terms
This website, www.stayingpower.co (the "Site"), is operated by Staying Power, LLC, an Oklahoma limited liability company and licensed insurance agency ("Staying Power," "we," "us," or "our"). These Terms and Conditions ("Terms") apply to your use of the Site, including our quiz, planning tools, scheduling features, and everything we publish on it.
By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
These Terms are separate from our Privacy Policy, which explains how we collect, use, and share your information, and from any consent you give us to be contacted. Please read all of them. If these Terms conflict with your consent to be contacted or with the Privacy Policy, the consent or the Privacy Policy controls on that subject.
2. What we do, and what we don't
What the Site is for. Staying Power is a licensed insurance agency. The Site gives you educational information and planning tools to help you think through how to prepare financially and logistically for aging at home, including how long-term care insurance may fit into a plan.
We are not an insurance company. We do not issue or underwrite insurance, and we do not decide or pay claims. Insurance companies do that, under the terms of their policies.
Nothing on the Site is an offer or a quote of coverage. Coverage is available only through an application to an insurance company, and only if the company approves it. Policy terms, benefits, availability, and prices differ by company, state, age, and health. The terms of the policy itself control over anything we say on the Site.
The Site does not give advice. The Site's content, quiz results, and estimates are general information. They are not insurance, legal, tax, financial, or medical advice, and they are not predictions about your own situation. Cost figures and statistics are estimates that change over time and vary by location. Please speak with a licensed professional about your circumstances before you make a decision.
We do not provide medical or care services. If you or someone you know is in an emergency, call 911.
3. Who you will speak with, how we are paid, and being contacted
Who you will speak with. When you schedule a call, you may speak with a licensed Staying Power agent, with a licensed agent from a Partner Agency, or with both on the same call. A Partner Agency is another licensed insurance agency we work with. We will tell you at the start of the call who is on it and which agency each person works for. For insurance products we are licensed to sell in your state, a Staying Power agent may handle your questions and your application. For products we are not licensed to sell, our agent will tell you and leave the call, and the Partner Agency's agent will continue on their own or on a separate call. We introduce you to a Partner Agency only with your consent, and we will name it when we ask.
Each agency is responsible for its own agents. Staying Power is responsible for the advice and recommendations of its own agents. Each Partner Agency is responsible for its own agents' licensed activities, advice, and recommendations.
How we are paid. We do not charge you to use the Site. We are paid by insurance companies and Partner Agencies, and the amount can differ by company and product. We can only offer or introduce you to companies and agencies we work with, so the Site does not show every option on the market.
Where we can help. We offer insurance products and services only in states where we and the people working with us are licensed.
Being contacted. If you submit your information and give your consent, you agree that we, and any Partner Agency named when you gave it, may contact you as that consent describes, including by phone, text message, and email. Your consent to be contacted is separate from these Terms. It is not a condition of buying any insurance or of using the Site. You can withdraw it at any time by replying STOP to any text, using the unsubscribe link in any email, or contacting us at the address in section 10, and we will honor your request within 10 calendar days.
4. Your information and the quiz
Give us accurate information. Quiz results, estimates, and any later recommendation depend on what you tell us. Please keep your answers accurate and complete.
Health-related answers. The quiz may ask about health, family, and care needs so we can help you plan. Share only what you are comfortable sharing. We use your answers as described in our Privacy Policy, and we share health-related answers with a Partner Agency only if you separately authorize it.
The quiz is not a medical assessment. It does not diagnose anything, and it does not predict whether an insurance company will approve you. Each insurance company decides that for itself during underwriting.
Information about other people. Submit information about another person, such as a spouse or parent, only if you have their permission or the legal authority to do so. We may need that person's own consent before we contact them.
Privacy. Our Privacy Policy explains how we collect, use, and share your information. It is part of these Terms.
5. Using the Site
Who may use it. You must be at least 18 years old, and you may use the Site only for your own personal, non-commercial purposes.
What you may not do. You agree not to:
- use the Site in a way that breaks any law or anyone's rights;
- give false information or pretend to be someone else;
- interfere with the Site or its security, or introduce malware;
- use bots, scrapers, or other automated means to access the Site, or try to reach data that belongs to other users; or
- copy or use the Site's content to build a competing service or to solicit our users.
We may suspend or block access to the Site if we believe you have broken these rules.
6. Our content and third-party links
Who owns the Site. The Site and everything on it, including text, graphics, logos, tools, and the Staying Power name, belongs to Staying Power or its licensors and is protected by law. You may view and use the Site for your own personal, non-commercial purposes. You may not copy, sell, modify, or distribute any part of it without our written permission.
What you send us. If you send us feedback or comments, you give us a non-exclusive right to use them to operate and improve the Site. We will not publish your name, image, or story, as a testimonial or otherwise, without your written permission.
Links to other sites. The Site may link to websites run by insurance companies, agencies, and others. We do not control those sites and are not responsible for them. Their own terms and privacy policies apply. A link is not an endorsement.
7. Disclaimers and limits on liability
The Site is provided as is. The Site and its content are provided "as is" and "as available." To the fullest extent the law allows, we do not make any promises, express or implied, about the Site, including that it is accurate, complete, suited to a particular purpose, or free of interruptions or errors.
Limits on what we owe. To the fullest extent the law allows, Staying Power and its members, officers, employees, and agents are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising from your use of the Site. For any other claim relating to the Site, our total liability will not exceed $100.
What these limits do not cover. These Terms apply to your use of the Site. They do not limit any duty we owe you as a licensed insurance agent when we provide insurance services to you, any right you have under insurance law, or any liability that the law does not allow us to limit. Some states do not allow certain disclaimers or limits, so some of the above may not apply to you.
8. Changes to the Site and these Terms
We may change, suspend, or discontinue any part of the Site at any time. We may also update these Terms. When we do, we will post the new version here with a new effective date. If you keep using the Site after that date, you accept the updated Terms. Changes to how we use your information are handled under our Privacy Policy.
9. Governing law and disputes
These Terms are governed by the laws of the State of Oklahoma, without regard to conflict-of-law rules. Any legal action relating to the Site or these Terms must be brought in the state or federal courts located in Tulsa County, Oklahoma, except where the law gives you the right to bring a claim in your home state. If any part of these Terms is found unenforceable, the rest stays in effect. These Terms and our Privacy Policy are the whole agreement between you and us about the Site.
